3 & 10 Year Bar to Admission:

The Immigration and Naturalization Act was amended September 1996 and now has serious penalties to persons who stay in the U.S. beyond the period authorized. Specifically, any alien who stays in the U.S. for more than 180 days after the date his/her I-94 card expires (unlawful presence), after April 1, 1997, or who violates their immigration status, and then departs the U.S., becomes inadmissible from the U.S. for 3 years. This is true even if an alien, who after leaving the U.S., secures a visa from a U.S. Embassy/Consulate.

Moreover, any alien who overstays in the U.S. for more than 1 year after his/her I-94 card expires (unlawful presence), after April 1, 1997, or who violates their immigration status, and then departs the U.S., becomes inadmissible from the U.S. for 10 years. These bars are in addition to any other status violations and potential penalties for violating status while in the U.S.

Formal waivers are available in very limited circumstances. An important reminder is that these bars can also apply if an alien has a pending Adjustment of Status petition (I-485, final step in the green card process), and then travels abroad after securing Citizenship and Immigration Services (CIS) travel authorization, and travels before the Resident Alien status is conferred.

Monitoring the validity of the I-94 card validity period and immigration status is critical for the alien, as well as for his/her dependant family in the U.S.
